Let’s talk about probate in general for folks who might not be familiar with it. When exactly is probate necessary?
That’s a great question, and one that comes up frequently. Essentially, probate is required when someone dies leaving assets in their name alone – meaning they weren’t part of a trust or held jointly with another person. The value of those assets matters too. In California, if the total value exceeds $184,500, probate is usually necessary.
Let’s dive into one of those steps in more detail. How about step V: Marshaling the Estate Assets?
Ah, marshaling! This step is crucial because it involves identifying and taking inventory of all the assets the deceased person owned. Think bank accounts, real estate, investments – anything of value.
We then need to determine the fair market value of each asset as of the date of death. This often requires appraisals from professionals. This entire process is documented in a formal Inventory and Appraisal document filed with the court (Forms DE-160/161).
