What sparked your passion for advocating for seniors?

Well, it’s been a journey! My grandmother faced some tough situations later in life, and seeing the vulnerability she experienced really opened my eyes. I realized how crucial legal protection is for our elderly population. It’s about ensuring their dignity, safety, and autonomy are respected.

Can you walk us through the process of elder protection?

Absolutely! Think of it as a multi-step journey designed to safeguard our seniors. We start with Initial Client Engagement – gathering information, assessing the situation, and formally establishing the attorney-client relationship. Then comes Case Assessment where we pinpoint the legal issues at play, gather evidence, and evaluate the risks involved.

Protective Actions follow, which might include anything from restraining orders to securing financial assets. Legal Proceedings could come into play if we need to pursue civil litigation or criminal charges. Long-Term Planning is essential for future security, involving estate planning and advance directives.

Finally, Case Resolution & Follow-Up ensures all outcomes are clearly communicated and that ongoing support is available.

Let’s delve into ‘Protective Actions.’ What are some of the key steps involved in this stage?

“Protective Actions” are often where things get truly critical. Our aim here is to immediately address any threats or harm an elder might be facing. Let’s say someone suspects financial exploitation. We’d likely freeze bank accounts, investigate suspicious transactions, and possibly even pursue legal action against the perpetrator.

  • If physical abuse is a concern, we’d work with Adult Protective Services (APS) and potentially seek restraining orders or protective injunctions.
  • In cases of diminished mental capacity, guardianship or conservatorship might be necessary to ensure the elder’s well-being and protect their assets.

It’s a delicate balance – we want to act decisively while respecting the individual’s autonomy as much as possible.

Remember that time when we had to move your client, Mrs. Henderson, into a safe facility after her caregiver was stealing from her? It was a tough situation, but we got her the help she needed.

What are some of the common challenges you face during this ‘Protective Actions’ stage?

Sometimes families can be divided – one sibling might want to protect the elder while another is involved in the exploitation. Navigating those dynamics requires sensitivity and careful communication.

Another challenge can be gathering enough evidence quickly. Financial abuse often involves complex transactions, and proving intent can be tricky. We need to be thorough and work closely with investigators if necessary.
