This involves identifying and inventorying assets, paying debts and taxes, and ultimately distributing the remaining property to heirs according to the will or state law.

Now, Steve, I understand trusts can play a significant role in estate planning and potentially help avoid probate altogether. Can you elaborate on this?

Steve: Absolutely. Trusts are legal entities that hold assets for the benefit of specific individuals or organizations. There are various types of trusts, but one commonly used is a Revocable Living Trust.

Revocable Living Trusts Explained

This type of trust allows the grantor – the person creating the trust – to maintain control over their assets during their lifetime. They can change the terms of the trust or even dissolve it entirely if needed. Moreover, upon the grantor’s death, the assets in the trust are distributed to the beneficiaries according to the grantor’s wishes, avoiding the lengthy and often expensive probate process. Consequently, this provides privacy and control that a will alone cannot offer.

Steve: While Revocable Living Trusts offer numerous benefits, it’s important to ensure they are properly funded.
