We start by deeply understanding our client’s goals – are they focused on minimizing taxes, protecting assets from creditors, or perhaps providing for a special needs child? Each objective shapes the strategy we employ.

It requires careful attention to detail and a thorough understanding of both federal and state laws. Think of it as creating a roadmap for your estate. A fireproof safe is a popular choice, but it’s not the only option. A secure lockbox or a dedicated file cabinet can also work well. The key is to choose a location that’s both safe and known to your executor, trustee, and healthcare agent. We often recommend providing copies of key documents to these individuals as well.

It’s not enough to simply store the documents; you also need to create a checklist or summary of your plan. This should include a list of all your estate planning documents, the location of your assets, and the contact information for your key advisors – your attorney, accountant, and financial advisor. This summary acts as a quick reference guide for your loved ones, making the process much smoother and less stressful. Many of our clients create a binder or digital folder containing all these materials. It’s a small effort that can save a lot of heartache down the road. A proper organization makes the process so much easier.

We also advise clients to inform their key advisors about the location of their estate planning documents. This ensures that they can assist your loved ones if needed. It’s about creating a team effort to ensure your wishes are honored. And don’t forget to regularly review and update your documents! Laws change, and your life changes. It’s important to keep your plan current. It’s an ongoing process, not a one-time event. When people think of estate planning, they often visualize a stuffy legal document, but it’s so much more than that. It’s a compassionate act of love and responsibility.

Oh, absolutely. One of the most common challenges is dealing with family dynamics. Sometimes, siblings disagree about how assets should be distributed, or parents struggle with the idea of relinquishing control. These emotional issues can often derail the estate planning process. It’s our job to mediate these conversations and help families reach a consensus. It’s not always easy, but it’s incredibly rewarding when we can help them find common ground. Sometimes, the toughest battles are not legal, but emotional.

Another challenge is helping clients understand the importance of funding their trusts. Many people create a trust, but they forget to transfer ownership of their assets to the trust. This defeats the purpose of the trust and can lead to probate, which is exactly what they were trying to avoid. It’s like building a beautiful house, but forgetting to put a roof on it! We spend a lot of time educating clients about the importance of funding their trusts and assisting them with the necessary paperwork.

And, of course, there’s the issue of procrastination. Many people put off estate planning because it’s uncomfortable or they think they have plenty of time. But life is unpredictable, and it’s always best to be prepared. We’ve seen too many situations where someone passed away without an estate plan, leaving their loved ones with a difficult and stressful situation. It’s a reminder that time is precious and that it’s never too early to start planning for the future.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
