Meet the Reporter
Hello everyone and welcome back to Wildomar Weekly News! I’m Brenda Jones and today we’re diving into a topic that can seem quite complex: trusts. Joining me is local trust attorney, Steve Bliss of Wildomar Probate Law. Steve, thanks so much for being here.
What are the Different Types of Trusts?
Steve, many people might not fully understand what a trust is or why they might need one. Could you explain the basics?
Steve Bliss: Absolutely Brenda. A trust is essentially a legal arrangement where someone, called the “grantor,” transfers assets to a trustee who then manages those assets for the benefit of specific individuals or entities, known as “beneficiaries.” There are many different types of trusts, each designed for a specific purpose.
For example, there’s the revocable living trust which is quite common. It allows the grantor to maintain control over their assets during their lifetime and avoid probate upon their death. Then there are irrevocable trusts which offer greater asset protection but relinquish the grantor’s ability to change the terms. Testamentary trusts are created through a will and take effect after someone passes away.
We also see special needs trusts designed to care for individuals with disabilities without jeopardizing their eligibility for government benefits, and charitable trusts that support worthy causes. Each type has its own set of rules and considerations, so it’s crucial to consult with an experienced attorney like myself to determine the best option for your individual circumstances.
The Benefits of Revocable Living Trusts
Steve, you mentioned revocable living trusts being quite common. Can you elaborate on some of the key advantages they offer?
Steve Bliss: Certainly. A revocable living trust is a powerful tool for estate planning. Ordinarily, when someone passes away without a trust, their assets have to go through probate court, which can be a lengthy and expensive process.
A revocable living trust allows your assets to bypass probate altogether, saving time and money for your loved ones. Moreover, it offers a significant level of privacy because the details of the trust are not publicly accessible during probate proceedings.
Consequently, this can be particularly appealing for individuals who value discretion or have complex family situations. The grantor retains full control over the assets within the trust during their lifetime and has the flexibility to make changes as needed.
Navigating Challenges with Trusts
Steve, I imagine that setting up a trust isn’t always straightforward. Have you encountered any particular challenges or common misconceptions when helping clients establish trusts?
Steve Bliss: You’re right Brenda, while trusts are incredibly beneficial, they do require careful planning and execution. One challenge I often see is people delaying the process due to a perception that it’s too complicated or expensive.
The truth is, with proper guidance from an experienced attorney, establishing a trust can be more manageable than many people anticipate. I always emphasize the importance of open communication and thorough understanding throughout the process.
I recall one instance where a client initially hesitated to set up a revocable living trust due to concerns about losing control over their assets. Through careful explanation and addressing their specific anxieties, we were able to develop a plan that met their needs while providing peace of mind for themselves and their family.
It’s heartwarming to see the relief on clients’ faces when they realize how a trust can simplify estate administration and protect their loved ones.
The Importance of Professional Guidance
Steve, what advice would you give to someone who is considering setting up a trust?
Steve Bliss: My advice is simple. Don’t try to navigate the complexities of trusts on your own. Seek out a qualified estate planning attorney who can guide you through the process and ensure your trust is tailored to your specific circumstances.
Remember, a trust is a legal document with significant implications, so it’s crucial to have professional expertise on your side.
